SEC Signals Crypto Custody Rules Are Coming: What It Means for Institutions

THE HEADLINE

The U.S. Securities and Exchange Commission is preparing a crypto custody proposal that could clarify how broker-dealers and investment advisers hold digital assets. The measure is currently under White House review, according to comments from Taylor Lindman, chief counsel of the SEC’s Crypto Task Force.

WHAT HAPPENED

Lindman said the proposal is intended to explain how a broker-dealer can carry non-security crypto assets without requiring a special registration regime. It is also expected to give investment advisers clearer guidance on where client assets may be held, including the role of state-chartered trusts.

Once the proposal clears review by the White House Office of Management and Budget, the SEC can publish it formally and open a public comment period. The rule is not final, and the details may still change during that process.

WHY IT MATTERS

Custody is one of the core bottlenecks preventing traditional financial institutions from handling crypto at scale. Clearer rules could reduce legal uncertainty for broker-dealers, advisers and qualified custodians, making it easier for regulated firms to build products around both security and non-security crypto assets.

The significance is structural rather than immediately bullish. A proposal would create a path toward regulatory clarity, but implementation will depend on the final language, the public-comment process and how the SEC treats different types of custodians.

CRYPTOLYFE VIEW

The SEC appears to be shifting from enforcement-led ambiguity toward infrastructure-level rulemaking. That is constructive for institutional adoption, but the market should separate a policy signal from a completed rule. Watch the formal proposal, eligibility requirements for custodians and whether the framework gives banks, trusts and crypto-native firms equal room to compete.

WHAT TO WATCH NEXT

• Publication of the formal SEC proposal

• The definition of a qualified crypto custodian

• Treatment of non-security crypto assets inside broker-dealers

• Industry feedback during the public-comment period
